non-Judicial Foreclosures

The process primarily used in California is the Non-Judicial Foreclosure process. It allows the lender to take a property to foreclosure sale much quicker, without having to go thru the longer drawn out judicial process. However there are civil codes that the trustee must follow to organize a legal Trustee Foreclosure Sale! The truth is Non-Judicial Foreclosures are a quicker process, and are not in your favor!

Foreclosure timeline

   There are five aspects of a Trustee’s Foreclosure Sale. The process starts with the initial Notice of Default. (N.O.D.), which lasts 90 days and is the best time to resolve any late (payments/arrears) owed to the lender.

   The Notice of Trustee Sale, begins the second stage allowing for an additional 21 days to resolve the payments in the arrears, beware the date posted is the actual Foreclosure Sale Date!

   The reinstatement period is the phase where you can fully reinstate the loan plus any late charges and penalties! This stage runs from the initial N.O.D. thru five days prior to posted foreclosure sale date.

   Redemption period references the last five days of the trustee process, it is the time period where the lender is no longer required to accept a reinstate, they can require the total balance of the loan in addition to all penalties associated with foreclosure process. At their discretion!

   Trustee Sale is the final stage whereby the property will be sold at auction on the court house steps, to the highest bidder. If the property is not sold at auction, title will be conveyed back to the lender and will become a Bank Owned property!
